TERMS AND CONDITIONS OF RENTAL (The formal stuff)

VILLA OCCUPANCY The villa is licensed by Osceola County, Florida for a maximum occupancy of ten(10) persons, including children and babies; this MUST NOT BE EXCEEDED.

BOOKING AND DEPOSIT A provisional booking may be made via the telephone or email. This will be held for up to ten days, as agreed by the Owner at the time of making the provisional booking, but unless the appropriate deposit / full payment is received the reservation will be terminated. In order to confirm your booking a deposit, of value agreed with the Owner , is required. Payment of the deposit confirms your acceptance of these terms and conditions.

BALANCE OF PAYMENT This will be payable six weeks prior to the date of departure. Bookings that are made within eight weeks of departure are payable in full at the time of the booking. The Owner reserves the right to terminate the booking if payment is not received by the due date. Rentals are inclusive of electricity, water and local taxes. Local telephone calls are free.

IF YOU TERMINATE YOUR BOOKING If you wish to terminate the whole or part of the booking once it has been confirmed, we must be informed in writing. The following termination charges will apply at the time of notification:* More than 6 weeks - Deposit only. * Between 4 and 6 weeks - 50% of total. * 4 weeks or less - 100% of total.

IF WE TERMINATE YOUR BOOKING In the event of circumstances beyond our control requiring us to terminate a reservation i.e. including Acts of God, civil disturbances, strikes, riots, political unrest, war or the threat of war, terrorist activities, industrial disputes, flood, drought, fire, legislation, technical/weather problems to transport, aircraft, closure of airports, sale of the villa, or any other event beyond the Owner's control. We the Owner, our servants or agents, will not be liable for any loss or damages sustained by the hirer in these circumstances and will only repay any Monies paid in respect of the reservation. In the event of termination, if required, we will attempt to find suitable alternative accommodation through our US Management Company, however this cannot be guaranteed.

SECURITY DEPOSIT A Security Deposit is required with the payment balance and will be refunded once the property has been cleaned and. The person making the reservation is responsible for any spillage/stains/damage deemed, by the property manager, to be over and above reasonable wear and tear. Minor upsets and breakages are usually regarded as normal wear and tear. Please report any damage to the property manager. In the case of such damage, reasonable cost to repair the damage or replace the item will be deducted from the security deposit before it is returned. Where the deposit is insufficient then you are responsible for paying any outstanding costs.

CLEANING. The Management Company will clean the villa between lets. This includes washing/changing bedding and towels and making beds; sweeping/mopping floors; hoovering carpets; cleaning bathroom and kitchen surfaces; cleaning inside refrigerator and microwave; dusting/wiping openly visible furniture, lamps, equipment and mirror surfaces.

You are responsible for keeping all villa items, including cooking/eating crockery and utensils, clean and useable whilst resident and leaving them in a similar state when you depart. This includes the oven interior and barbecue. Please keep these clean and, if necessary, use the oven’s cleaning cycle to clean fat spillage from the oven interior before you depart. You are also responsible for cleaning up any spillage or stains on carpets, walls, fabrics, furniture and appliances as and when they occur and you are also responsible for removing your own belongings, items and any debris and trash before you leave. If a stain needs specialist treatment please contact the Management Company. Villa items that have been used or taken from storage must be cleaned and returned to where you found them, before you leave.

DEPARTURE : Cleaning the villa between lets is a cost-limited and time-critical activity and you should help to make the management company’s cleaning task efficient and to schedule. The cleaner’s job is not to tidy up a mess left by untidy or inconsiderate guests but to make sure that essential cleaning tasks, as described above, are carried out before the next guest arrives. You should maintain the villa in a clean and tidy state whilst resident and leave it in this state when you depart. In order to facilitate a timely and efficient clean and to avoid losing personal items you should carry out the following checks and take appropriate action before you depart:

The Management Company may charge for any significant extra work or cleaning activity that results from lapses in the above client responsibilities or from you not acting in a reasonable, tidy and considerate manner when you depart. Any such charges will be deducted from the security deposit.

ARRIVAL / DEPARTURE TIME Check in time is 5.00pm and check out time is 10.00 am. This allows time for the villa to be cleaned between lets in preparation for the next client who may be arriving later the same day. These times may be varied if there is no back-to-back booking that day but only after you have agreed any revised time with the Management Company or owner. You may enter the villa before 5pm only if the cleaning has been completed. NOTE: An unexpected late departure can waste the cleaner's time and incur costs. The Management Company will charge late fees if the villa is found still occupied after 10am if there has been no prior agreement for a later checkout. We will deduct any late fees charged by the Management Company from the security deposit.

SWIMMING POOL The property has a private swimming pool. No glasses or crockery are allowed within the pool area. (Plastic cups and plates are provided). The Owner does not accept any liability for any injury however caused as a result of the use of the pool. Guests, especially parents of small children, are asked to take especial care around the pool and not to allow unsupervised children to use the pool. The pool cover is not strong enough to be stepped on. The pool is not designed for diving. Solar heating is provided year round at no cost. Whilst this system has been sized by its installer to provide swimming temperatures throughout the year the actual temperature of the pool will depend on many factors including; the time of year; prevailing weather conditions; time of day; use of the pool cover etc. No guarantees are made as to the actual pool temperature the system will attain on any one day. Auxiliary electric heating, if required in winter months, is charged as an additional extra. Local laws apply.

AIR CONDITIONING We advise you to keep all windows and external doors closed whenever possible; not only will this help to keep bugs from the property, but it will also enable the air conditioning unit to function more efficiently and prevent damage to the air conditioning unit due to excessive run times.

SECURITY SAFE Use of the combination safe is free but conditional. If you require assistance from the property manager or a locksmith to retrieve your possessions from the safe, for example because you have changed and/or lost the combination, you agree to pay all charges. If you don't agree to this then please do not use it. Do not change the combination.

PROPERTY MAINTENANCE The Management Company and appointed tradesmen have the right to enter the property for carrying out repairs or general maintenance e.g. the cleaning of the swimming pool, garden, repairs in the villa etc.

TRAVEL AND HEALTH INSURANCE All members of the party are advised to take out adequate insurance to cover all eventualities such as terminations, accidents, loss, sickness and damage. All matters arising with regard to loss or injury should be directed to the respective insurance company. Guests are reminded to exercise care as to the personal safety of themselves and all party members. Whenever possible valuables should be left secure and out of sight.

LIABILITY The Owner or Owner's agents do not accept any liability whatsoever for death, personal injury, accidents, loss from the villa or safe, loss or damage to person(s) or personal effects however caused whilst staying in or about the rental property.

INVENTORY No items may be removed from the villa. This includes linens and towels. Please report any breakage or damage to the Management Company. You accept that you are responsible and will pay for any loss or damage caused by any of your party as deemed by the property manager.

CODE OF CONDUCT Country Creek Estates is a residential community. The actions of all the members of your party should not interfere with the enjoyment of either other vacationers or residents of Country Creek Estates. Please do not play loud music or engage in any activity that may cause inconvenience to your neighbours after 10:30 pm or before 07:30 am.

PROBLEMS OR COMPLAINTS In the unlikely event that you experience any problems with the property please contact the local Management Company who will do their best to assist and rectify the matter as soon as is practically possible. Should a problem remain unresolved the Owner must be notified in England immediately. Every effort has been made to ensure the accuracy of descriptions concerning the property and services. However, we reserve the right to change without notice fixtures, fittings and general decor as part of ongoing development and maintenance of the property. Also we cannot be held responsible for any errors, omissions and changes beyond our control

PETS Pets are not permitted.

INSECTS Florida is a sub-tropical state and as such insects and small creatures are inevitable and are not a cause for complaint. Their presence is no reflection on the cleanliness of the property. The home is treated regularly as part of a pest and termite control program. If pest appearances are not isolated or they persist then notify the Management Company so it can rectify the situation.
